In addition to the potential State Board of Equalization regulatory
reversal we discussed this morning, please also be aware that AB 81
(Migden) is being gutted and amended to provide for SBOE assessment of all
electric generating facilities that produce 50 MW or more of generation.
It is going to be heard off the Assembly Floor on Thursday.

Attached is the bill in its current form, and the following language is
proposed for insertion into it:

In line 1 of the heading, strike out "Members Midgen and Aroner", strike
out line 2 and insert: Member Migden

In line 1 of the title, strike out "amend Section 6203 of" and insert: add
Section 721.5 to

On page 2, strike out line 1 and insert:

SECTION 1. Section 721.5 is added to Revenue and Taxation Code, to read:

721.5. (a) Notwithstanding Section 721 or any other provision of law to the
contrary, the board shall annually assess every electric generation
facility with a generating capacity of 50 megawatts or more that is owned
or operated by an electrical corporation, as defined in subdivision (a) of
Section 218 of the Public Utilities Code.
(b) This section shall be construed to supersede any regulation, in
existence as of the effective date of this section, that is contrary to
this section.

On page 2, strike out lines 2-26, inclusive, and strike out pages 3 to 5
inclusive.

The IEP Regulatory Affairs Committee approved the creation of a new,
Property Tax Subcommittee. The Regulatory Affairs Committee is noticing
the
entire IEP membership inviting participation by all the commpanies
interested in property tax matters.

Last week, Controller Connell indicated an interest in shifting the
jurisdiction over property tax assessment applied to electric generators
from the local level to the State Board of Equalization (SBE). IEP engaged
in this matter in 1998/1999. Attached is a brief summary memo of the key
issues at that time. At that time, IEP successfully argued for retaining
jurisdictional authority at the local level.

The SBE may take this issue up at its June 20, 2001 meeting. The SBE is
comprised of five voting members. The membership is divided 3:2 between
democrats and republicans.

The initial meeting of the Subcommittee will be a conference call scheduled
for 9:30 a.m. (PST) on Thursday, May 31. During this meeting, we will be
discussing policy positions and/or statements that IEP may wish to take, as
well as any tactical matters to be addressed at this time.
