Having reviewed your proposed language for Section 101(d) -=20 DIRECT ACCESS FOR SELLERS AND BUYERS OF ELECTRICITY, I suggest the followin= g=20 reworking: ? ??????????? Section 101(d) -?????? Within sixty (60) Days after enactment of this=20 Section, the FERC shall promulgate a rule that permits certain retail users= =20 of electricity in the Western Systems Coordinating Council to purchase thei= r=20 electric requirements from suppliers other than the distribution utility in= =20 whose franchise and/or certificated service territory they are located.?=20 Retail users eligible for this direct access option shall include all=20 non-residential users having a peak-day load requirement in excess of 70 kw= .?=20 The direct access option shall be phased in according to the following=20 schedule: ? ??????????? ?90 Days after enactment:??? 1 MW and greater loads ??????????? 180 Days after enactment:? 300 kw and greater loads ??????????? 270 Days after enactment:? 100 kw and greater loads ??????????? 360 Days after enactment:?? 79 kw and greater loads ? =20 ??????????? Section 101(e) - ????? FIRM PHYSICAL TRANSMISSION RIGHTS IN THE= ??=20 WESTERN SYSTEMS COORDINATING COUNCIL ? ??????????????????????? Within sixty (60) Days' after enactment of this=20 Section, the FERC shall promulgate a rule that requires each Independent=20 System Operator and/or Regional Transmission Operator responsible for the= =20 operation of transmission facilities in the Western Systems Coordinating=20 Council to adopt measures for the identification and allocation, through=20 auction, of firm, physical transmission rights on the systems that they=20 manage.? Such rights will be structured to provide physical access through= =20 defined constrained interfaces ("flowgates") on the transmission system,=20 without additional compensation during times of congestion.? The auction=20 procedure shall be structured to permit each distribution utility to obtain= =20 an allocation of rights sufficient to meet the projected requirements of it= s=20 retail load other than load made eligible for direct access under Section= =20 101(d).? The initial term of the transmission rights so auctioned shall be = no=20 greater than one year.?
