Attached is FERC Chairman Jim Hoecker's conurrence with the FERC's December
15 order in the SDG&E complaint case. Note the discussion on page 11 where
he asserts very broad jurisdiciton to order refunds and address any unlawful
behavior by sellers under section 309 of the Federal Power Act.
