APS shall enter into a maximum Tariff rate transportation contract effective 4/1/01 - 3/31/02 for 8,000 Dth/d of East of Thoreau to California capacity. The associated letter designates Transwestern as agent for capacity release transactions such that Transwestern retains an agency fee equal to 50% of any revenues realized through the release of the capacity at rates above maximum Tariff rate.
